The general contract conditions form an integral part of any proposal, purchase order and purchase order confirmation of the products marketed by NSI SRL.
The general conditions concern the sale to a consumer and/or a professional (customer).

All prices shown are inclusive of Italian taxes (VAT 22% included) as per Directive 98/6 / EU implemented by the Consumer Code, Legislative Decree 206/2005 art. 14-17. The mandatory information is established by law (Legislative Decree no. 114 of 31.03.1998, art. 14 and 22). The sale price, as well as the price per unit or set, are clearly, unambiguously and legible; this applies to every product featured on this website. NSI SRL is not responsible for taxes imposed by other countries and complies with the current rules on transparency and commercial ethics.

Payments can be made by PayPal or Bank Transfer.

PayPal: choosing this form of payment will be redirected directly to the PayPal site. To complete the operation, you will need to log in with your data and confirm the payment.

Bank transfer: in this case, you must make the bank transfer with the amount, the reference of the order and the name, surname/company name of the originator at your bank. Bank data will be highlighted in the order, if you choose this payment method, NSI SRL will process the goods after having received confirmation from its bank of the availability.

The order will be accepted and the goods will be put into production only after having certified the customer’s purchase (payment received, either in the bank or on a PayPal account) and in the case of a B2B customer, after verification of the community VAT number (authorization to the VIES service).
An email with the order will be sent to the customer who can send any changes to NSI SRL before shipping the order.

The cost bands relating to transport are automatically generated based on the purchase and the amount. The customer can select between on-site pick-up (no cost) or single item shipping.

It is also possible to entrust the collection to your partner courier or to personally forward a request for collection through various online services such as sending Italian Post or Packlink. In these cases, just select « pick up on-site » during the purchase phase.

Shipments are normally guaranteed in 1 (one) working day for all accessories in the warehouse and 30 (thirty) working days from the receipt of the order for all products made to measure or that require special processing. NSI SRL reserves the right to notify the customer if the processing times exceed the term of 5 working days. Delivery is guaranteed in 24/48 hours – barring complications – by TNT, SDA, KIPOINT or another courier.

Transferee private subject – The issuance of the invoice is not mandatory if it is not requested by the customer any later than the time of order. Besides, the mail-order business is exempt from the obligation to certify the fees (receipt or tax receipt) according to art. 2, paragraph 1, lett. oo), of Presidential Decree no. 696/96;

Transferee taxable subject VAT – Obligation to issue an electronic invoice according to the ordinary rules related to invoicing.

In the event of an invoice request, the customer must necessarily provide his certified e-mail address (PEC) or the recipient code (unique code) for the transit of electronic invoices to and from the interchange system (SDI).

Transferee taxable person intra-community VAT – in case of request of the invoice by an intra-community subject authorized to the VIES service, the invoice is issued with VAT exemption (operation not taxable according to art. 41 D.L. 331/1993).

The Order ID (identification code) will be stored in the NSI SRL database for the time necessary to execute the order itself and – in any case – by the law. The user can access the order and / or the data relating to the same, through his personal account or – if impossible – by requesting NSI SRL.

Transfer of risk under art. 63 Legislative Decree 06.09.2005 n. 206 c.d. Consumer Code (article replaced by article 1, paragraph 1, of Legislative Decree 21 February 2014, n. 21 Legislative Decree 21/2014)

In contracts that place an obligation on the seller to ship the goods, the risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the consumer only when the latter, or a third party designated by him and different from the carrier, physically enters into possession of the goods.

However, the risk is transferred to the consumer already at the time of delivery of the goods to the carrier if the latter has been chosen by the consumer and this choice has not been proposed by the professional, without prejudice to the consumer’s rights towards the carrier.

We advise the customer to always receive the goods with reserve.

According to art. 52 Legislative Decree no. 206/2005, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes unrelated to any business or professional activity that may be carried out, or does not make the purchase by indicating a VAT number on the order form), has right to withdraw from the contract for any reason, without the need to provide explanations and without any penalty, except as indicated in art. 59 D.Lgs. Cit. The Customer, although a consumer, does not have the right to exercise the withdrawal in case of an order for customized or personalized products (letter c) art. 59 cit.). Therefore, the customer choosing items such as chairs of a particular varnishing or custom-made chairs, etc. expressly waives the right of withdrawal at the time of order confirmation. In any case, in response to the timely communication following the confirmation of the order and any case before the production of the customized product has started, the customer can still exercise the right of withdrawal.

To exercise the right of withdrawal, the Customer must send NSI SRL within 14 (fourteen) working days from the date of receipt of the goods, communication in which you manifest your will to exercise this right. The communication must be anticipated by email to [email protected] and, necessarily, sent by registered letter with acknowledgment of receipt within and no later than the following 48 hours to NSI SRL. Once the withdrawal form has been received, NSI SRL will communicate to the Customer – via email – the methods and address to which to send the goods to be returned in addition to the return authorization number to be indicated for the return procedure which, in any case, must be attached to the product. The Customer must ship the product carefully packing it in its original packaging, avoiding to damage it with adhesive labels or other. The package must contain everything originally contained.

To take advantage of the right of withdrawal, therefore, the Customer must keep all the original packaging delivered and return them intact together with the goods and what is contained in the package. The shipping costs for returning the goods are charged to the customer. The shipment by the Customer must be made by courier within 14 (fourteen) working days of the communication made by e-mail from NSI SRL concerning the address to which the goods are to be shipped and the return authorization number. The shipment, up to the certificate of receipt by NSI SRL, is under the responsibility and risk of the Customer. Upon receipt of the goods, NSI SRL will verify its integrity and refund the customer the amount of the product purchased, with the exclusion of transport costs. The refund will be made by bank transfer to the current account indicated by the Customer, within the term of 14 (fourteen) days from the receipt by NSI SRL of the returned goods. If the order consists of products tailored to the customer or with a particular painting, therefore, difficult to place on the market again, NSI SRL reserves the full right to charge the entire amount, if the right to withdrawal is asserted after the start of production.

The right of withdrawal can be exercised only concerning the product purchased in its entirety; it is not possible to exercise withdrawal on parts of the purchased product (e.g. accessories, guides, ropes, straps, etc.).

The purchased product must be returned intact, in the original packaging and complete in all its parts (including the packaging and any documentation and accessories: instruction manuals, etc.). The affixing of adhesive tapes, labels and the like directly on the original product packaging should be avoided in all cases. In the event of damage to the goods during transport, NSI SRL will notify the Customer of the incident within five working days of receipt of the product at its warehouses, to allow the Customer to promptly file a complaint against the courier chosen by him. and obtain any refund of the value of the product (if necessary, the Customer had taken steps to ensure it). NSI SRL is not liable for damage, theft or loss of products returned with uninsured shipments at the expense of the customer.

The right of withdrawal lapses in the event of a substantial defect in the integrity of the returned goods, and thus by way of example in the case of:

lack of external packaging and/or original internal packaging;
absence of integral elements of the product (accessories, parts, etc.);
damage to the product for reasons other than its transport;
abnormal state of conservation.
In the event of forfeiture of the Customer’s right of withdrawal, NSI SRL will return the purchased product to the Customer, charging the shipping costs to the same.

Jurisdiction: in case of disputes with consumers concerning issues related to the execution of the sales contract, the court of the consumer’s place of residence is competent, if located in Italy.

All custom-made products have a 120-month warranty. For all the warranty conditions to take effect, do not autonomously intervene in the disassembly of parts or accessories that may appear to be non-functional, but contact the company within 60 days from the moment you notice the defect in the goods. The company itself will provide assistance and replacement of the parts.

The warranty includes the complete replacement of the product or parts of the same when operating defects arising from manufacturing defects occur and, on the other hand, excludes the damage and deterioration caused by the customer. In any case, NSI SRL does not guarantee the deterioration and oxidation and corrosion phenomena that could derive from the exposure of the products to temperate zones with high pollution with a significant presence of sulfur dioxide or if subject to chloride exposure and if placed – moreover – in contact with other metals that could cause galvanic corrosion.
